Terms of Service

These Terms of Service ("Terms") govern your use of the MileTrack mobile application and website (collectively, the "Service"), operated by Asset Track Sp. z o.o. ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. Service Description

MileTrack is a mileage tracking application that automatically records vehicle trips, classifies them as business, commute, or private, and generates tax-compliant mileage reports for the country profiles currently supported in the app.

The Service includes:

• Automatic trip detection and GPS-based route recording
• Smart classification of trips (business, commute, private)
• Trip review and edit tools with audit history
• Country-specific profiles currently covering US, UK, DE, FR, IT, NL, PL, SE, NO, FI, IE, ES, DK, CA, AU
• Consolidated mileage reports in PDF, CSV, and XLSX formats
• Accounting-ready export schema for external accounting workflows

2. Free Access and Rollout

MileTrack is currently offered free of charge. While the product is still being rolled out, the following may apply:

• iOS TestFlight builds are the primary beta distribution channel
• Android beta rollout is staged and may be limited by region or device support
• Access may still be enabled in waves so we can manage reliability, support load, and device coverage
• Core mileage tracking and export features are available at no cost
• No credit card is required to use the Service in its current form
• The Service may contain bugs or incomplete features
• We reserve the right to modify, limit, or discontinue features during this period

If we ever introduce paid plans in the future, we will publish updated terms and obtain any required consent before charging you.

3. Account Registration

• You must be at least 16 years old to use the Service
• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must notify us immediately of any unauthorised use of your account
• One person or legal entity per account, unless a business plan allows multiple users

4. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or disassemble the application
• Interfere with or disrupt the Service or its infrastructure
• Share your account credentials with third parties
• Upload malicious content or attempt to gain unauthorised access to other users' data
• Use the Service to generate fraudulent tax records or mileage claims
• Scrape, crawl, or use automated means to access the Service beyond its intended API

5. Your Data and Content

You retain ownership of all data you create within the Service, including trip records, vehicle information, workplace data, and exported reports.

By using the Service, you grant us a limited licence to process, store, and transmit your data solely to provide and improve the Service. This licence terminates when you delete your account.

You are responsible for the accuracy of your mileage records. MileTrack provides tools to support tax compliance, but the Service does not constitute tax advice. You should consult a qualified tax professional regarding your specific obligations.

6. Location Data and Permissions

The Service requires access to your device's location services to function. By enabling location tracking, you consent to the collection and processing of your GPS data as described in our Privacy Policy.

You can disable background location access at any time through your device settings or in-app controls. Disabling location access will prevent automatic trip detection.

7. Accuracy and Limitations

• GPS accuracy depends on device hardware, environmental conditions, and satellite availability
• Automatic trip classification is based on learned patterns and heuristics — it may occasionally produce incorrect results
• Distance calculations may vary slightly from vehicle odometer readings
• You are responsible for reviewing and correcting trip data before submitting it for tax purposes

MileTrack provides trip-field correction tools so you can fix inaccuracies while maintaining an edit history for audit transparency. Segment-level route editing may be introduced in a future release.

8. Intellectual Property

The Service, including its design, code, branding, and documentation, is the intellectual property of Asset Track Sp. z o.o. and is protected by copyright, trademark, and other applicable laws.

"MileTrack" and the MileTrack logo are trademarks of Asset Track Sp. z o.o. You may not use our trademarks without prior written permission.

9. Third-Party Integrations

The Service provides structured exports designed for use with third-party accounting tools (such as Xero, DATEV, Sage, and others). Direct API connectors are not available in the current beta and may be introduced in later releases.

• Third-party services are governed by their own terms and privacy policies
• We are not responsible for the availability, accuracy, or security of third-party services
• Data shared with third-party integrations is only transmitted when you explicitly initiate an export or connection

10. Service Availability

We aim to provide reliable, continuous access to the Service, but we do not guarantee 100% uptime. The Service may be temporarily unavailable due to:

• Scheduled maintenance (we will notify you in advance when possible)
• Unplanned outages or technical issues
• Force majeure events beyond our reasonable control

11. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, express or implied
• We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service
• Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim (or zero while the Service remains free)
• We are not liable for incorrect tax filings, missed deductions, or penalties resulting from inaccurate mileage data — you are responsible for verifying your records

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

12. Indemnification

You agree to indemnify and hold harmless Asset Track Sp. z o.o., its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

• You may delete your account at any time through the app or by contacting us at [email protected]
• We may suspend or terminate your account if you violate these Terms
• Upon termination, you may request an export of your data within 30 days — after which your data will be permanently deleted (subject to legal retention requirements)

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes at least 14 days before they take effect, via email or in-app notification. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of Poland. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Warsaw, Poland.

If you are a consumer in the European Union, you retain the benefit of any mandatory consumer protection provisions in your country of residence. You may also use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Asset Track Sp. z o.o. regarding the use of the Service.
